I have devised and implemented legal strategies for major acquisitions and development projects, including implementation of initial infrastructure investments of >$600MM; acquisition of utility company for $221MM, acquisition of natural gas storage facility ($40 MM); divestiture of Mexican LDC assets; new service for major steel plant; expansion of poultry grow house and AG irrigation businesses; LNG plant optimization; storage field expansion and pipeline expansion; expansion of non-regulated products and services and marketing.

Notable Cases

  • Grynberg Qui Tam ActionU.S. District Court (WY). Successfully defended nation-wide Qui Tam action and copy-cat state class action, involving allegations of mismeasurement of gas produced on federal lands and claimed damages over $1 BN.

  • Fred J. Joseph v. Mile High Capital Group, Ltd., Denver District Court (CO). Represented court-appointed receiver in a matter involving the collapse of a high-profile multimillion dollar company.

  • RGG v. Corkin, et al., Jefferson County District Court (CO). Successfully prosecuted and resolved claims involving violation of non-compete covenants in the sale of a large online marketing business.

  • Lamb v. Kinder Morgan, Inc. et al., U.S. District Court (CO). Successfully defended and resolved national class action alleging securities fraud and claimed damages over $400 MM. 

  • KN TransColorado, Inc. v. Questar Corporation, et al., Garfield County District Court (CO). Successfully prosecuted breach of fiduciary duty claimsin fierce pipeline partnership action between two major energy companies; ~$300 million in damages.

  • Dirt Hogs, Inc. v. Natural Gas Pipeline Company of America, et. al.,Caddo County District Court (OK). Secured early dismissal of $100 million RICO case.

  • Grynberg v. Rocky Mountain Natural Gas and In re Rocky Mountain Natural Gas, numerous concurrent actions in state and federal courts (CO), and before Federal Energy Regulatory Commission and state PUCs. Successfully defended complex breach of contract action involving violations of the NGPA and the Natural Gas Act.
